United States legislation offers protection for the immigrant benefits of women and children who are victims of domestic abuse. In the Immigration Act of 1990, exceptions were created for the removal of conditions on permanent residence to allow a battered immigrant to maintain her permanent residence status without the cooperation of her abusive spouse or parent. In 1994, the Violence Against Women Act (VAWA) included provisions that allows an immigrant woman who is the victim of domestic abuse to file an immigrant visa petition on her own behalf if she, or her children, has been abused by the U.S. Citizen or LPR spouse or parent.
